These Terms and Conditions (“Terms”) govern your access to and use of the mobile application 37 (the “App”), operated by HiiPointe Games LLC (“we,” “us,” or “our”).
 

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
 

1. Eligibility

You must meet the minimum age required in your jurisdiction to use the App. If you are under the age of majority, you may only use the App with the consent and supervision of a parent or legal guardian.

 

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App solely for personal, non-commercial entertainment.

We may suspend or terminate this license at any time if you violate these Terms.
 

3. Accounts / Usernames / Data Collection

Username (Required)

A username (display name) is required to play. Usernames are pseudonymous gameplay identifiers and are not intended to identify you personally. You agree not to include personal or inappropriate content in your username. Usernames may be changed at any time within the App.

 

Optional Account Linking

You may optionally create an account using an email address and password to save and transfer progress across devices. Providing an email address constitutes personal information, which is collected and used solely to enable account features as described in our Privacy Policy. Providing this information is voluntary. Without account linking, gameplay progress may be lost if the App is deleted, you log out, or you change devices.

You are responsible for maintaining the confidentiality of your login credentials. We may remove or suspend accounts that violate these Terms.

4. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how information is collected, used, and protected. By using the App, you agree to the practices described in the Privacy Policy.
 

5. Free Access and Advertising

The App is free to download and play. We do not require payment information and do not offer purchases or subscriptions.

The App is supported by third-party advertising. By using the App, you acknowledge that advertisements may be displayed. We are not responsible for the content or practices of third-party advertisers.
 

6. Acceptable Use

You agree not to:

• use the App for unlawful or harmful purposes

• attempt to interfere with or disrupt the App or servers

• attempt to gain unauthorized access to systems or accounts

• reverse engineer, copy, modify, or distribute the App

• exploit bugs or manipulate gameplay unfairly

We may restrict or terminate access for violations.
 

7. Intellectual Property

All content, software, designs, graphics, trademarks, and materials within the App are owned by HiiPointe Games LLC or its licensors and are protected by intellectual property laws. You may not reproduce or distribute any part of the App without permission.
 

8. Service Availability

We may update, modify, suspend, or discontinue any part of the App at any time without notice. We are not responsible for loss of gameplay data or interruptions of service.
 

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

YOUR USE OF THE APP IS AT YOUR OWN RISK.
 

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HiiPointe Games LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROGRESS, OR PROFITS, ARISING FROM YOUR USE OF THE APP.
 

11. Indemnification

You agree to indemnify and hold harmless HiiPointe Games LLC from any claims, damages, or expenses arising out of your use of the App or violation of these Terms.
 

12. Termination

We may suspend or terminate your access to the App at any time for violations of these Terms or misuse of the service.

You may stop using the App at any time and may request deletion of any linked account in accordance with our Privacy Policy.
 

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after updates constitutes acceptance of the revised Terms.
 

14. Governing Law

These Terms are governed by the laws of the United States and the State of Missouri, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Kansas City, Missouri.
